A Trump executive order aims to override state AI rules, but states are pushing back and key deadlines in March 2026 could shape what happens next.

The Trump administration signed an executive order on Dec. 11, 2025, called “Ensuring a National Policy Framework for Artificial Intelligence.” Its goal is to reduce the patchwork of different state AI laws and replace it with a more uniform federal approach.
The order sets up several ways to challenge state rules. The Justice Department created an AI Litigation Task Force, active since Jan. 10, 2026, to help fight state AI laws in court. It also ties about $42 billion in federal broadband funding to states repealing what the administration calls “onerous” AI rules, which is like telling states they may only get the money if they agree to change their local rulebook.
Another deadline is close. The order tells the Federal Trade Commission, a federal consumer protection agency, to treat some state-required “bias mitigation” rules as potentially deceptive by March 11, 2026. Bias mitigation means steps meant to reduce unfair outcomes from AI, like trying to stop a hiring tool from favoring one group over another.
At the same time, states are not simply backing down. Colorado delayed parts of its AI Act until June 30, 2026. Utah narrowed its AI Policy Act in 2025 by adding safe harbors, which are clearer “if you do X, you are probably okay” rules.
There is still no clear evidence that tech companies have already saved money or boosted investment because of this regulatory fight. Watch the March 11 deadlines, possible lawsuits, and whether Congress advances the proposed TRUMP AMERICA AI Act, which could lock these federal priorities into law.
