What happened

Scale AI, an AI company backed by Meta, filed two lawsuits against the Department of Defense in late January 2026. The suits challenge a government buying decision, after Scale lost a bid for a contract worth up to $708 million.

The contract came from the National Geospatial-Intelligence Agency, which is part of the Defense Department. It was described as the agency’s largest agreement for training AI systems. It could last up to seven years and is linked to the Pentagon’s Maven program, which uses AI to help analyze images and other data.

Scale AI first tried to fight the decision through the Government Accountability Office, which is a federal watchdog that reviews contract complaints (like a referee for government purchasing disputes). That protest was dismissed in late January 2026. Two days later, Scale sued in the US Court of Federal Claims, a court that hears money and contract disputes involving the federal government. Enabled Intelligence, the company that won the bid, joined the case to protect its interests.

Many details are unclear because key documents are sealed. The court filings include classified information marked “secret/no foreign,” meaning it cannot be shared with foreign nationals. A Scale spokesperson said the lawsuit is about a “recent procurement decision” and said the company supports Defense Department AI efforts.

Why it matters

These cases show how high the stakes are as the US military buys more AI services. When contracts are this large, losing bidders may use protests and lawsuits to push for a redo, but the public may learn little when the work involves classified information.
