A federal judge in San Francisco questioned the Defense Department’s decision to blacklist Anthropic, suggesting it may be retaliation over AI use limits.

On March 24, 2026, U.S. District Judge Rita F. Lin raised doubts about the Department of Defense’s decision to label Anthropic as a “supply chain risk” during a hearing in San Francisco. The department was renamed the Department of War under the Trump administration, according to the report.
A “supply chain risk” label is a type of government blacklist for buying technology. It can limit or block a company’s products and services from being used in government contracts.
The dispute traces back to Anthropic’s refusal to allow its AI models to be used for mass domestic surveillance or fully autonomous weapons. President Trump directed federal agencies on Feb. 27, 2026 to stop using Anthropic’s AI over a six-month phase-out. Soon after, the Department of War sent letters dated March 3, 2026 applying the supply chain risk designation to Anthropic’s products, services, and affiliates.
In court, the government argued there could be risks, including a hypothetical “kill switch” (a built-in off switch) that could disrupt IT systems. Judge Lin called that a “pretty low bar” and questioned whether national security concerns could be handled simply by stopping use of Anthropic’s technology, rather than blacklisting the company. She also suggested the action looked retaliatory.
Anthropic says the designation is baseless and is seeking a temporary pause through a lawsuit filed March 9, 2026.
This is reported to be the first time the U.S. government has used this supply chain power against a U.S. company. The case could set boundaries on when the government can effectively shut a tech firm out of federal work, especially when the disagreement is about how the technology may be used.
