Devin Kim filed a California lawsuit against xAI and SpaceX, saying he was fired for warning about safety risks in the Grok chatbot.

Devin Kim, a former engineer at Elon Musk’s xAI, filed a lawsuit in California state court. He says he was pushed out after repeatedly warning leaders about safety problems while working on Grok, xAI’s chatbot (a program that talks with you in text, like a customer service chat).
According to the complaint, Kim was worried Grok could encourage discrimination and could help people find information about weapons of mass destruction. The lawsuit points to past public incidents involving Grok, including offensive and hateful outputs, as examples of the kinds of risks he says were not taken seriously.
The lawsuit also claims Kim faced retaliation from his supervisor, xAI co-founder Jimmy Ba, after Kim pushed for more testing and safeguards. It says Ba tried to avoid required testing tied to European Union rules during the release of “Grok Code 1.” The complaint says Musk is not accused of causing the safety problems, and instead is described as telling the company to follow the law.
xAI and SpaceX did not immediately respond to requests for comment, according to TechCrunch. Kim is seeking compensatory and punitive damages, plus a court declaration that the companies acted unlawfully.
This case puts a spotlight on how AI products are tested before they reach the public. For regular people, it is like arguing over whether a car maker rushed a new model onto the road without enough crash tests (except the “crashes” can be harmful information and harassment spreading quickly online).
